I. Scope
- These General Terms and Conditions (GTC) apply to all contracts for the temporary rental of apartments for accommodation purposes, concluded between Pineapple Apartments GmbH (hereinafter referred to as "Pineapple Apartments") and third parties (hereinafter referred to as "Guest"), as well as to all additional services and deliveries provided by Pineapple Apartments in this context (accommodation contract).
- The use of the booked apartments by more than the agreed number of persons and subletting or further rental of the booked apartments is prohibited. The use of the provided apartment for purposes other than accommodation requires the written consent of Pineapple Apartments.
- The accommodation contract between Pineapple Apartments and the Guest is concluded through a written reservation confirmation (regardless of the form).
II. Payment Terms
- The price of the entire booked accommodation service must always be paid by the Guest in advance.
- Valid payment method is PayPal.
- The Guest agrees that an invoice will always be made available as a download or sent by email. If the Guest wishes to receive the invoice by post, a longer delivery time may occur.
III. Cancellation Terms
- A confirmed reservation can be canceled by the Guest free of charge according to the specified cancellation terms. After the cancellation deadlines have passed, cancellation is excluded, and Pineapple Apartments retains the right to the agreed payment. The same applies in case of no-show by the Guest.
- The Guest has the right to withdraw from the contract free of charge up to 4 weeks before arrival. For cancellations up to 14 days before arrival, the Guest is obligated to pay 50% of the agreed price. The cancellation must be made in writing.
IV. Use of Reserved Apartments
- A reserved apartment is available to the Guest from 3:00 PM on the day of arrival until 11:00 AM on the day of departure.
- Unless otherwise agreed, the provided keys must be handed over to Pineapple Apartments or a third party designated by Pineapple Apartments on the agreed departure day, or, if agreed, left in the apartment. If a handed-over key is lost or not returned upon departure, a fee of 50.00 euros will be charged. Pineapple Apartments reserves the right to claim compensation for any damage caused by this, exceeding the amount of 50.00 euros. This includes the costs for replacing the affected locking system if necessary for security reasons.
- Upon request and depending on availability, a later departure (Late Check-out) can be agreed with Pineapple Apartments in advance. If Pineapple Apartments agrees to a Late Check-out, Pineapple Apartments is entitled to charge 15.00 euros per started hour for the additional use of the apartment. For departures after 1:00 PM, the full daily rate of the apartment will be charged. There is no contractual right to a Late Check-out.
- Upon request and depending on availability, an earlier arrival (Early Check-In) can be agreed with Pineapple Apartments in advance. If Pineapple Apartments agrees to an Early Check-In, Pineapple Apartments is entitled to charge 15.00 euros per started hour for the additional use of the apartment. There is no contractual right to an Early Check-In.
V. Termination of the Accommodation Contract
- Pineapple Apartments is entitled to terminate the accommodation contract for good cause. Good cause particularly exists if (i) force majeure or other circumstances not attributable to Pineapple Apartments make the fulfillment of the contract impossible; (ii) apartments are culpably booked under misleading or false information or by concealing essential facts; essential may include, but is not limited to, the identity of the Guest, the ability to pay, or the purpose of the stay; (iii) Pineapple Apartments has justified reason to believe that the use of the service may jeopardize the smooth operation of the business, the safety or the reputation of Pineapple Apartments and its locations in public, without this being attributable to the domain or organizational area of Pineapple Apartments; (iv) the purpose or occasion of the stay is illegal; or (v) in the case of resale/rental or further brokerage (see I).
- Pineapple Apartments must inform the Guest immediately of the exercise of the right of termination.
- In the event of justified termination of the accommodation contract by Pineapple Apartments, the Guest is not entitled to compensation.
VI. Party/Non-Smoking Clause
- Pineapple Apartments manages exclusively non-smoking apartments. Smoking is not permitted in the apartment. Smoking is allowed outside the building or on the balcony. In this case, the Guest is obligated to close doors and windows to prevent smoke from entering the apartment. In case of violation, Pineapple Apartments has the right to claim a compensation amount of 250.00 euros from the Guest for the additional cleaning costs (including cleaning of all items and textiles by an external company). This compensation amount is to be set higher if Pineapple Apartments proves higher damage, for example, due to loss of revenue from not being able to rent the apartment to subsequent guests.
- Holding parties or bachelor parties in the apartments of Pineapple Apartments is not permitted. In case of violation, Pineapple Apartments has the right to claim a compensation amount of 500.00 euros from the Guest for the additional cleaning costs, including any loss of revenue from not being able to rent the apartment as a result. This compensation amount is to be set higher if Pineapple Apartments proves higher damage.
VII. Theft / Damages
- If damages occur that go beyond normal wear and tear or if theft occurs, Pineapple Apartments has the right to charge the Guest for the damage as well as the additional expenses for remedying the damage, including any loss of revenue from not being able to rent the apartment as a result.
VIII. Pets
- Pets of any kind are not allowed in the apartment. In case of violation, Pineapple Apartments has the right to claim a compensation amount of 500.00 euros from the Guest for the additional cleaning costs, including any loss of revenue from not being able to rent the apartment as a result. This compensation amount is to be set higher if Pineapple Apartments proves higher damage.
IX. Maintenance
- The Guest is obligated to treat the provided apartment, furnishings, and the rooms, facilities, and installations intended for communal use with care and to ensure proper ventilation and heating.
- The Guest is also obligated to check the furnishings for completeness and usability when moving into the apartment and to immediately report any complaints to Pineapple Apartments.
- The Guest is liable for all damages to the provided apartment, furnishings, and the rooms, facilities, and installations intended for communal use, caused by him or his visitors through improper or incorrect use and not attributable to normal wear and tear. The Guest must immediately report any damages occurring in the provided apartment to Pineapple Apartments.
X. Final Provisions
- Amendments and supplements as well as the cancellation of the accommodation contract, the acceptance of the application, or these General Terms and Conditions must be in writing. This also applies to the waiver of this written form clause. Unilateral changes or additions by the Guest are invalid.
- The place of performance and payment is the registered office of Pineapple Apartments GmbH.
- Exclusive place of jurisdiction in commercial transactions is the registered office of Pineapple Apartments GmbH. If a contracting party fulfills the requirements of § 38 para. 2 ZPO and has no general place of jurisdiction in the country, the place of jurisdiction is the registered office of Pineapple Apartments GmbH.
- The law of the Federal Republic of Germany applies, excluding the UN Sales Convention and conflict of laws.
- If individual provisions of these General Terms and Conditions are or become ineffective or void, this does not affect the validity of the remaining provisions. Otherwise, the statutory provisions apply.
- Pineapple Apartments is neither willing nor obligated to participate in a dispute resolution procedure before a consumer arbitration board.
